Tearing Down and Rebuilding in San Jose: The Demolition Permit

Many San Jose homeowners who want a new house already own the lot. The usual path is a knockdown-rebuild: remove the existing home, then build a new one in its place. In San Jose, the demolition itself needs a building permit, and the City lists several items you have to line up before you apply.

  • BAAQMD job number. Every demolition needs a job number from the Bay Area Air Quality Management District, whether or not the project involves asbestos.
  • PCBs Screening Assessment Form. Required for all demolitions. Wood-framed buildings and single-family homes are exempt from PCB testing, but the completed form still goes in with the application.
  • Plot plan and compaction work. For a full demolition, the plot plan shows distances to property lines and any pools or septic tanks. Where the old footprint will become buildable area again, a licensed engineer prepares a stamped demolition, drainage and compaction plan, and the backfill compaction is observed and reported to the Building Division.
  • PG&E gas service removal. Once the permit is approved, PG&E must be contacted at least 30 days before the scheduled demolition to disconnect and remove the gas service.
  • Deposit and debris. The permit carries a refundable Construction and Demolition Diversion Deposit collected at issuance, and debris boxes on the street are handled by a City-approved hauler under an encroachment permit.

When the demolition is part of a new-home proposal, the Planning permit for the new house covers it. A single-family home can also be demolished without separate Planning clearance when no Single-Family House Permit is required and a building permit for the replacement home has been approved. Does Your New San Jose Home Need a Single-Family House Permit?

A new house in San Jose sometimes needs a Single-Family House Permit from the Planning Division before the Building Division will issue a building permit. Whether yours does is one of the biggest early factors in the schedule. The City requires this permit when any of these apply:

TriggerCity threshold
HeightOver 30 feet or more than two stories
Floor area ratio (FAR)Over 0.45 (garage, basement, accessory structures and an ADU are not counted)
Creek proximityWithin 100 feet of a riparian corridor on a lot of 1/2 acre or larger
Historic statusHouse or site on the Historic Resources Inventory
Impervious surface10,000 sq. ft. or more created, replaced or reconfigured

If none apply, you can go straight to a building permit. If the permit is required, the Director of Planning decides it through either administrative review or a public hearing. Projects that miss the administrative criteria go to a hearing, which the City says takes more time and an extra fee, and neighbors within 300 feet are notified. Designing the house to fit under the triggers, or to meet the administrative criteria, is often the simplest way to keep a rebuild moving. A clear floor plan with the FAR worked out early helps here. 2025 Energy Code: Solar and Electric Rules for New Homes

New homes are held to California’s Energy Code. Buildings whose permit applications are submitted on or after January 1, 2026 must comply with the 2025 Energy Code, which expands the use of heat pumps in new homes, encourages electric-readiness and strengthens ventilation standards. Source: California Energy Commission

Solar is part of the base requirement. The 2025 code requires a solar PV system on newly constructed single-family homes, with five exceptions. What this means for a rebuild:

  • The minimum system size depends on climate zone, conditioned floor area and number of dwelling units, and it is capped by the usable solar roof area.
  • No system is required if the usable roof area is under 80 contiguous square feet, or if the calculated minimum is under 1.8 kWdc.
  • Adding a qualifying battery (at least 7.5 kWh) can reduce the required PV size by 25 percent.
  • Panels do not have to be on the house roof. They can be ground-mounted or on a carport on the lot.
  • These rules apply to new construction, not to additions or alterations of existing homes.

The CEC notes it does not mandate specific fuel types, but its 2025 baselines for homes assume heat pumps for both space heating and water heating. Source: 2025 Energy Code Fact Sheet. How long does it take to build a new home in San Jose?

Most custom home projects take 9 to 15 months from design to final walkthrough. Factors include design complexity, permitting, and weather.

Do you handle permits and city approvals?

Yes. We manage all required permits, inspections, and planning submittals to ensure your project is compliant and efficient.

Can I customize the entire layout of my new home?

Absolutely. We specialize in custom homes designed around your lifestyle. From the number of bedrooms to the kitchen layout and smart home features, every element is tailored to your needs.

Are green building materials available for my new home?

Yes. We offer green building options that include sustainable materials, high-efficiency systems, and solar-ready designs to reduce your carbon footprint and lower long-term energy bills.

What neighborhoods in San Jose do you serve?

We build across San Jose including West San Jose, Willow Glen, North Valley, and Evergreen. We also serve nearby cities such as Santa Clara, Sunnyvale, and Cupertino.

Do you offer smart home features?

Yes, our smart home upgrades include integrated lighting, climate control, doorbell cameras, and security systems. These features are increasingly requested by San Jose homeowners looking for added comfort and control.

Do I need a separate demolition permit to tear down my house and rebuild in San Jose?

Yes, demolishing a building requires a building permit, with a BAAQMD job number and a PCBs Screening Assessment Form. When the demolition is part of the new-home proposal, the Planning permit for the new house covers the demolition, so no separate Planning clearance is needed.

Does a new home in San Jose have to have solar panels?

Generally yes. The 2025 California Energy Code requires solar PV on newly constructed single-family homes, with five exceptions, such as usable roof area under 80 contiguous square feet or a calculated minimum under 1.8 kWdc. Panels can be on the roof, a carport or the ground.

What makes a San Jose new home go to a public hearing?

If the house needs a Single-Family House Permit and does not meet the City’s administrative review criteria, such as staying within 30 feet and two stories, it goes to a public hearing. That adds time and a notification fee, and neighbors within 300 feet are notified.
