Interior Decorator, Interior Designer or Contractor: Who Does What in California

Search for an interior decorator in San Jose and you will see decorators, interior designers and remodeling contractors side by side. They overlap, but in California they are treated differently.

RoleWhat California law says
Interior decoratorChapter 3.9 of the Business and Professions Code does not create a license for decorators. Section 5805 says nothing in the chapter keeps Certified Interior Designers “or any other person” from submitting interior design plans to local building officials, except as provided in Section 5538.
Certified Interior DesignerA protected title. The California Council for Interior Design Certification issues it to people who pass an approved exam and meet education and experience requirements, and it must be renewed every two years (Sections 5800, 5811 and 5811.1).
Licensed contractorSection 5800 describes certified designers’ plans as work “of sufficient complexity so as to require the skills of a licensed contractor to implement them.” A certified designer is exempt from contractor licensing only “insofar as they are designing systems for work to be performed by a licensed contractor” (Section 5803).

Two points are worth knowing when you compare firms. It is an unfair business practice for anyone without a valid certification to use the title “Certified Interior Designer” or terms such as “licensed,” “registered” or “CID” that suggest they are certified (Section 5812). It is also an unfair business practice for anyone, certified or not, to advertise that they are “state certified” to practice interior design (Section 5804). If a firm uses these words, ask for the certification number. Chapter 3.9 is currently set to remain in effect only until January 1, 2027, unless the Legislature extends it (Section 5810).

Where Decorating Ends and a Permitted Remodel Begins in San Jose

A decorating refresh and a remodel often happen in the same room, but the City of San José treats them differently. Its Building Division lists these cosmetic improvements as not requiring a building permit:

  • Painting
  • Cabinet refacing or replacement
  • Countertop replacement
  • Floor finishes such as carpet, linoleum and tile
  • Tile installations with no structural change
  • Sheetrock and taping joints (fire-rated sheetrock does need a permit)

The City says a building permit or subtrade permit is legally required for new construction, additions, alteration of walls or any structural change, and for electrical, plumbing and mechanical work unless exempted. Installing major appliances is also on the permit list. Swapping outlets or switches in existing boxes is exempt, but new lighting circuits or fixtures in new locations are not on the exempt list.

In practice, a new paint scheme, rugs and furniture stay on the decorating side. A lighting plan that adds recessed lights, a kitchen with a relocated sink, or an open-concept wall removal becomes permitted construction. The City also notes that state law requires you to disclose unpermitted work when you sell, and that insurance generally won’t cover damage related to unpermitted work.

If your decorating ideas include moving walls or adding lighting, plan them with a design-build team so the design and the permit are handled together. Source: City of San José, When Is a Building Permit Required?

How Finish Selections Fit a Remodel Schedule

In a remodel, many finish choices are construction decisions made early, not decorating decisions made at the end. Some selections set dimensions and locations that the crew builds around before the walls are closed:

  • Plumbing fixtures: the faucet, shower valve and toilet you choose affect where pipes and valves are roughed in.
  • Light fixtures: fixture type and placement decide where boxes and wiring go, which is part of the electrical permit scope.
  • Appliances and cabinets: sizes drive cabinet layout, outlets and venting.
  • Tile and flooring: material thickness affects transitions between rooms and door clearances.

Other choices, such as paint colors, cabinet hardware, window coverings and furniture, can usually be finalized later without changing the work already done.

Lead times vary widely by product and supplier, so ask each supplier or your contractor for current lead times before the start date is set, and confirm special-order items are in hand or scheduled before demolition begins. A change after rough-in can mean reopening finished work, so it usually costs less to decide early.

What does an interior decorator do for San Jose homes?

An interior decorator enhances the look and functionality of your home by selecting color schemes, furniture, lighting, and decor elements that reflect your personal style. In San Jose, decorators also consider natural light, tech integration, and the modern lifestyle of Silicon Valley residents.

How much does it cost to hire an interior decorator in San Jose, CA?

Costs vary based on project size and scope, but most interior decorating services in San Jose range from $1,500 to $10,000+. Brother and Brother Builders provides clear, upfront estimates tailored to your needs and budget.

What's the difference between an interior designer and an interior decorator?

Interior designers often focus on structural and functional design, requiring formal education. Interior decorators specialize in surface aesthetics, like furnishings, wall color, and accessories. Brother and Brother Builders offers both decorating and full design-build services for a complete solution.

Can you help with interior decorating for small homes or apartments in San Jose?

Absolutely. We specialize in smart space planning and style for compact layouts, common in downtown San Jose and neighboring areas like Milpitas and Sunnyvale.

How long does an interior decorating project usually take?

The average decorating project takes 2–6 weeks, depending on the room size and whether furniture or custom items are ordered. We provide a detailed timeline during your consultation.

Do you offer eco-friendly or sustainable decorating options?

Yes! Many San Jose homeowners prefer sustainable materials. We source eco-friendly paint, reclaimed wood, organic fabrics, and low-impact furniture for clients who prioritize environmental responsibility.

Does California license interior decorators?

No state license is created for decorators under Chapter 3.9 of the Business and Professions Code. The chapter protects the title “Certified Interior Designer,” which the California Council for Interior Design Certification issues after an exam plus education and experience requirements. Using that title, or terms like “CID” or “licensed,” without a valid certification is an unfair business practice under Section 5812.

Do I need a permit to repaint, replace flooring or change cabinets in San Jose?

Usually not. The City of San José lists painting, floor finishes such as carpet and tile, cabinet refacing or replacement, and countertop replacement as cosmetic improvements that don’t need a building permit. Moving walls, structural changes, and most new electrical, plumbing or mechanical work do need a permit.

When should I choose finishes for a remodel?

Before construction starts for anything that affects rough-in, such as plumbing fixtures, shower valves, light fixtures, appliances, cabinets and tile. These set pipe, wiring and cabinet locations. Paint colors, hardware and furniture can usually wait. Ask suppliers for current lead times so special-order items don’t hold up the schedule.
