How Design Review and Permits Work in Saratoga
Saratoga runs its own permit process through its Community Development Department at 13777 Fruitvale Avenue. The Building Division (408-868-1240) takes permit applications online through eTRAKiT, and all inspection requests must also be made online. Before a building permit, many projects first need Residential Design Review from the Planning Division. The City lists these triggers:
- A new house, or a new accessory structure over 250 sq ft
- Expanding a home by more than 50%, or changing the footprint by more than 50%
- Adding or increasing a second story by 100 sq ft or more
- Adding or expanding a basement, or rebuilding after full or partial demolition
Design review follows one of three paths. Projects that meet every objective design standard can be approved at staff level through a ministerial review that is not appealable. Projects that ask to depart from those standards go to Administrative Design Review, with notice mailed to owners within 250 feet. Projects needing a variance, use permit or similar approval go to a Planning Commission public hearing, with notice to owners within 500 feet. The City says initial review comments come within 30 days. Source: City of Saratoga, Residential Development
Smaller projects below these thresholds may go straight to the Building Division, and the City asks homeowners to confirm that with the Planner of the Day (408-868-1222 or planning@saratoga.ca.us). Checking this before design starts tells you which timeline to plan around.
Saratoga Neighborhoods, Hillside Lots and What They Mean for Remodels
Saratoga began around an 1848 sawmill on what is now Saratoga Creek, grew into an orchard town, and became a residential city after World War II, incorporating in 1956. Source: City of Saratoga, History. Neighborhoods include Brookview and Pride’s Crossing in the north, Blue Hills and Greenbrier in the northwest, and Congress Springs in the southwest. The area bounded by Saratoga Avenue, Saratoga-Sunnyvale Road and Cox Avenue is mostly four-bedroom ranch homes on quarter-acre lots, and Parker Ranch in the hills has 1-acre minimum lots. Source: Wikipedia
Several City rules shape remodels on these lots:
- Slope and hillside zoning: lots with an average slope over 10% lose part of their net site area for floor area math. In the Hillside Residential (HR) district, no structure may come within eight feet of the top of an adjacent major ridge without dense tree cover. Source: HR district summary
- Geotechnical clearance: required for new structures, basements or additions in areas with landslide or liquefaction potential.
- Protected trees: an arborist report is required when work comes within five feet of a protected tree’s canopy dripline, including a neighbor’s tree. Source: City of Saratoga
- Fire zones: parcels in the Wildland Urban Interface or a fire hazard severity zone need Santa Clara County Fire Department review, and plans must specify ignition-resistant construction and ember-resistant vents. Source: City of Saratoga
For a ranch house addition or a hillside custom home, the City’s Interactive GIS Map shows which of these apply to your parcel.
Remodeling Near the Village and Saratoga's Heritage Homes
The downtown along Big Basin Way is known as the Village, and Saratoga is known for landmarks such as Villa Montalvo, the Mountain Winery and Hakone Gardens. Source: Wikipedia. On April 1, 2026, the City adopted the Village Design Standards Ordinance, which turns the 2019 Village Design Guidelines into objective, measurable development standards.
Older homes get extra attention. The City keeps a Heritage Resource Inventory of historic buildings, including designated landmarks and two Heritage Lanes, Austin Way and Saratoga Avenue, and its Heritage Preservation Commission advises on the Heritage Preservation Ordinance. The City points owners to the Secretary of the Interior’s Standards for preservation, rehabilitation, restoration and reconstruction. Owners of qualified historic properties can apply for a Mills Act agreement, a 10-year contract that lowers assessed value in exchange for maintaining the property’s historic character. If your home is on the inventory or on a Heritage Lane, check with the Planning Division before changing exterior materials, windows or rooflines, since alterations can need a separate heritage application.

It depends on scope. Saratoga requires Residential Design Review for a new house, expanding a home by more than 50%, adding or increasing a second story by 100 sq ft or more, adding or expanding a basement, and a new accessory structure over 250 sq ft. Smaller projects may go straight to the Building Division; the Planner of the Day (408-868-1222) can confirm.
Saratoga caps an ADU at 1,200 sq ft of living area, not counting a garage. An ADU inside required setbacks is limited to 1,000 sq ft, or 800 sq ft in the front setback, and an attached ADU cannot exceed 50% of the main home’s living area. New ADU construction must match the main home’s color, and ADUs up to 750 sq ft are exempt from impact fees.
Often, yes. Most trees with a trunk diameter of 10 inches or more are protected in Saratoga, and some native trees at 6 inches. An arborist report is required when work comes within five feet of a protected tree’s canopy dripline, including a neighbor’s tree, and removing a protected tree needs a permit, even if it is dead.
