Permits in the Town of Los Gatos, From Bathrooms to Additions
Los Gatos is an incorporated town, so permits here go through the Town of Los Gatos, not San Jose or the County. The Town’s Building Division at 110 E. Main Street (408-354-6876) reviews plans for all new construction, additions and remodels and inspects the electrical, plumbing and mechanical work. Applications start as a pre-application on the Town’s online permit portal; staff check that the file is complete, fees are paid, and review comments and resubmittals are handled through the same portal. The Town also offers a Permit Decision Tool to identify which permit a project needs, and contractors must hold a current Town business license to pull permits.
For bathroom remodels and kitchens that do not change the structure, the Town has a Kitchen and Bathroom Non-Structural Express Check submittal. Its bathroom checklist includes:
- At least one dedicated 20-amp circuit for bathroom receptacles, with all receptacles GFCI protected
- A mechanical exhaust fan that is ENERGY STAR compliant, humidistat controlled and vented outside
- A shower of at least 1,024 square inches that fits a 30-inch circle, with a pressure-balanced or thermostatic valve
- Moisture-resistant backer board to 70 inches above the drain; green board and paper-faced gypsum are not accepted in wet areas
- Safety glazing for windows in or near the tub or shower
The same form notes that any exterior change (windows, doors, siding) needs Planning approval, homes in an HOA need an HOA approval letter, and moving or adding plumbing fixtures requires a West Valley Sanitation District certificate. Town construction hours are 8 a.m. to 6 p.m. weekdays and 9 a.m. to 4 p.m. Saturdays, with no work on Sundays or Town holidays.
Historic Districts and Hillside Standards in Los Gatos
The Town treats a structure as historic if it sits in one of five historic districts, carries the Landmark Historic Preservation (LHP) overlay, or is a primary structure built before 1941 (unless the Town has determined it has no historic significance). The districts are Almond Grove, Broadway, Fairview Plaza, University/Edelen and the Downtown Commercial district. Broadway was the town’s first residential subdivision, laid out in 1881, and about three quarters of the homes in Fairview Plaza were built before 1900. Source: Town of Los Gatos
For historic homes, minor repairs with in-kind materials need only a building permit. Exterior changes such as street-visible additions, new porches, dormers, bay windows or a change in siding go to the Historic Preservation Committee, and interior work that affects the exterior counts too. The Town charges no extra fees for historic applications, and owners of identified historic buildings may use the State Historic Building Code. Source: Town of Los Gatos
Up the slopes toward the Santa Cruz Mountains, the Hillside Development Standards and Guidelines apply. Adopted in 2004, they cover new hillside homes and major additions and remodels in the mapped hillside area, which includes all HR and RC zoned land and some R-1 lots with steep slopes. They start with a site constraints analysis, and hillside tree replacement follows separate tree rules. Knowing which category your house falls into shapes the scope of a room addition or second story before design starts.
ADU and Junior ADU Rules in Los Gatos
ADUs and junior ADUs in Los Gatos are governed by Division 7 of Chapter 29 of the Town Code, and the Town runs a streamlined process: one application form and one plan review to reach a building permit. The Town also hosts an ADU Plans Gallery of pre-approved plans under Assembly Bill 1332; the Town states that no modifications to those plans are allowed, however minor. Source: Town of Los Gatos ADU Information
The Town’s ADU summary handout (last updated April 2024) lists these standards:
- A maximum ADU size of 1,200 square feet; a JADU of up to 500 square feet inside the house or an attached garage
- An ADU may not be built in front of, or added to an existing second story of, a historic primary dwelling
- When a garage is converted to an ADU, lost parking for the main house does not need to be replaced
- Short-term rentals are prohibited in ADUs approved after February 6, 2018
The rules are changing. The Planning Commission recommended an updated ADU ordinance on June 10, 2026, and the Town Council scheduled it for August 4, 2026, so confirm the current standards with the Planning Division (408-354-6874) before design. If you are weighing an ADU or a garage conversion, check historic and hillside status first, since both affect where a unit can go.

Bathroom remodels are permitted by the Town of Los Gatos Building Division, which offers an Express Check path for non-structural kitchen and bath remodels. Plans must show items such as GFCI outlets on a 20-amp circuit, an ENERGY STAR humidistat fan vented outside and moisture-resistant backer in the shower. Exterior window or door changes also need Planning approval, and moved or added fixtures need a West Valley Sanitation District certificate.
The Town treats a property as potentially historic if it is in one of its five historic districts (Almond Grove, Broadway, Fairview Plaza, University/Edelen or Downtown Commercial), has the Landmark Historic Preservation overlay, or has a primary structure built before 1941. The Planning Division keeps historic inventories and Sanborn maps and can confirm your home’s status.
They apply to new homes and major additions and remodels on lots shown on the Town’s Hillside Area Map, which covers all HR and RC zoned land and some R-1 lots with steep slopes. The Town’s interactive GIS map and the Planning Division can tell you whether your parcel is in the hillside area.
